Terms of Use
These Terms govern access to BYOAgent and form an agreement between you and BYOAgent. By creating an account, submitting content or purchasing a service, you agree to these Terms.
1. Marketplace role
BYOAgent supplies technology that lets homeowners prepare and publish property listings and connect with buyers and independent property professionals. BYOAgent is not your real-estate agent, conveyancer, legal adviser, financial adviser or representative, and does not negotiate or enter a sale contract for you.
2. Eligibility and accounts
You must be at least 18, be legally able to enter this agreement, provide accurate account information and keep your login secure. You are responsible for activity performed through your account. Staff may suspend accounts where necessary to protect users, comply with law or investigate misuse.
3. Property listings
You must own the property or have authority to advertise it. Listing information, pricing, dimensions, features, photographs and statements must be accurate, current and not misleading. You are responsible for required disclosures, contracts, inspections, identity checks, legal advice and compliance with laws applying to your sale.
Listings are reviewed before publication, but review is not legal verification or a guarantee of accuracy. BYOAgent may reject, pause, edit for formatting, or remove content that breaches these Terms or creates legal, safety or platform risk.
4. Enquiries and communications
Buyer enquiries are delivered to the listing owner. Users must not send spam, harassment, unlawful content or deceptive messages. BYOAgent may apply rate limits and anti-abuse controls. Users should independently verify the identity and intentions of people they communicate with.
5. Professional directory
Photographers, conveyancers and auctioneers are independent businesses. Directory approval or featured placement is not an endorsement, warranty or guarantee of qualifications, availability, insurance, pricing or work quality. Users must perform their own checks and enter any engagement directly with the professional.
6. Packages and payments
Package prices, duration, photo limits, placement features and benefits are shown before checkout. Payment is processed by Stripe. Higher packages may affect genuine ordering or featured eligibility but do not guarantee views, enquiries, buyers, price or a sale. Package access begins only after verified payment.
Refunds and cancellations are handled under the Refund Policy and rights that cannot lawfully be excluded, including applicable Australian Consumer Law rights.
7. Content licence
You retain ownership of content you submit. You grant BYOAgent a non-exclusive, worldwide, royalty-free licence to host, reproduce, resize, display and distribute that content as reasonably required to operate, promote and secure your listing or professional profile. This licence ends when content is removed, except for backups, audit evidence and legal retention.
8. Prohibited conduct
You must not impersonate another person, scrape or attack the service, bypass access controls, upload malicious material, infringe rights, publish discriminatory or unlawful content, manipulate rankings, or use the platform for fraud or unsolicited marketing.
9. Availability and changes
BYOAgent aims to provide a reliable service but does not promise uninterrupted availability. Features may change where reasonably necessary for security, law, performance or platform operation. Material changes to these Terms will be published with an updated effective date and, where appropriate, require renewed acceptance.
10. Liability
Nothing in these Terms excludes rights or remedies that cannot be excluded by law. To the maximum extent permitted by law, BYOAgent is not responsible for property transactions, user representations, independent professionals, external websites, indirect loss or decisions made using marketplace content.
11. Ending access
You may close your account from account settings. BYOAgent may restrict or end access for serious or repeated breaches, fraud, security threats, non-payment or legal requirements. Transaction, consent, support and audit records may be retained where reasonably required by law or legitimate business obligations.
